Alternatives to Incarceration with Recovery Courts

Tennessee has 82 recovery courts which offer the option of substance abuse treatment in place of incarceration. The courts handle supervision, drug testing, treatment services, immediate sanctions and incentives. The program is intensive, but offenders who are willing to complete the program graduate with sobriety and a new life.

The program is only offered to nonviolent offenders with substance use disorders. Completing the program results in a reduction of correctional costs and increases the likelihood of successful recovery. The offender will be under legal and clinical supervision with treatment, mandatory periodic drug testing, community supervision and other rehabilitation services.

A second extension of recovery courts is DWI (driving while impaired) court. This program is for repeat offenders. Included is close monitoring of offenders, home and field visits, ignition interlock devices and transdermal alcohol detection devices.

Another extension of recovery courts is Juvenile Drug Court. This program is for youth identified as having issues with alcohol and/or other drugs. Weekly meetings of the juvenile treatment court team and the family of the youth are spent discussing best methods for addressing substance abuse and related problems of the youth.

Family dependency treatment is a program for parents charged with substance abuse issues. Judges, attorneys, child protection services and treatment personnel work together to rehabilitate the parent and give them a chance to regain custody of their children.

Treatment Funding for Court Ordered Offenders

In Tennessee there are several resources for funding required treatment. Alcohol and Drug Addiction Treatment (ADAT) covers those convicted of DUI, are unable to pay for services and are court ordered to enter treatment. Covered services include residential rehabilitation, halfway houses and outpatient continuum of care services.

The Supervised Probation Offender Treatment (SPOT) program covers costs of alcohol and drug treatment services for offenders who are sentenced to supervised probation and are at risk of violating probation due to substance use. This service covers residential rehabilitation, halfway houses and outpatient continuum of care services.

The Community Treatment Collaborative service provides substance abuse treatment service for probation and parole technical violators. This service covers outpatient treatment, intensive outpatient programs (IOP), halfway houses, residential treatment, social detox and medically monitored detox.
